General Terms And Conditions |
For shopping in the SMILYs Net Shop Nicole Cochems the following general terms and conditions are valid:

| § 1 Ordering And Conclusion |
The orderer can put the ware in his shopping cart by clicking. He can edit his shopping cart at every time. The final order of the ware
is done with the order form. Immediately after sending the order form the orderer will get a confirmation email that the order was dispatched.
This email contains again all data of the order. The order is not a sales contract yet but an offer to conclude one with the seller.
The conclusion is done when the orderer receives another confirmation email including the seller's bank account.

| § 2 Conditions Of Payment |
Only pre-payment will be accepted as payment. The payment can be done per bank transfer (recommended) or per mail.
After ordering with following confirmation email the orderer will receive another email with the particulars of the seller's bank
account for being able to transfer. The amount has to arrive within 10 working days after ordering. If it does not, the order will be
considered as invalid and deleted together with all data of the orderer.

| § 3 Prices |
All prices are net equal to gross and do not conclude any value added tax. The prices exclude the forwarding expenses which
have to be added to the total amount.

| § 4 Forwarding Expenses |
Depending on weight and size the articles join the forwarding class 1 or 2. The forwarding class is quoted in the categories.
The forwarding expenses for the two classes are as follows (amounts are flat):

Europe here contains the same countries as the list of the Deutsche Post (status 07-01-2004):
Albania, Andorra, Armenia, Austria, Azerbaijan, the Azores, Belarus (White Russia), Belgium, Bosnia-Herzegovina, Bulgaria,
the Canary Islands, Croatia, Cyprus, Czech Republic, Denmark, Estonia, the Faro Islands, Finland, France, French Guiana,
Georgia, Great Britain, Greece, Greenland, Guadeloupe, Hungary, Iceland, Ireland, Italy, Kazakhstan, Kosovo, Latvia,
Liechtenstein, Lithuania, Luxembourg, Macedonia, Madeira, Malta, Martinique, Mayotte, Monaco, the Netherlands, Norway, Poland,
Portugal, Republic of Moldavia, Republic of Slovakia, Réunion, Rumania, the Russian Federation, San Marino, Serbia and
Montenegro, Slovenia, Spain, St. Pierre and Miquelon, Sweden, Switzerland, Turkey, Ukraine and the Vatican City
If the order value is 35.00 € or higher the delivery is free of forwarding expenses.

| § 5 Right Of Revocation |
In writing (also per email) or by return of the ware the orderer can revoke the deal within one month from the date of order.
If the order value is more than 40.00 € the seller will repay the costs for sending back the ware. In this case the seller can
retain a loss of value caused by use of the ware if necessary. To keep the time limit sending the revocation or the ware in time will
suffice.

| § 6 Terms Of Delivery |
The ware will be delivered by the Deutsche Post to the address the orderer quoted. The ware will be sent to the orderer within 3
working days after arrival of payment.

| § 7 Package |
Due to Package Decree we have to take back package of our products, which don't have a sign of a comprehensive waste disposal system (as f.ex. "Grüner Punkt" by Duales System Deutschland AG or "RESY"-Symbol) and to care for their recycling or waste disposal. Concerning such products please contact us for further clarification. We will name you a communal collection point then or a waste disposal enterprise in your ambiance which will take the package back for free. If this is not possible, you can send back the package to us.

| § 8 Condition Of The Ware |
Beside of new ware also b-ware (that means new, unused articles with little blemishes) and used ware is offered. B-ware and
used ware are separately characterized, and their condition is accurately described.
